Terms of Service

Welcome to BabbleNest! These Terms of Service (the "Terms") constitute a legal agreement between you (as a parent or guardian of a child, "you") and the BabbleNest Development Team ("we," "us," or "our") regarding your use of the BabbleNest children's language learning application (the "Service").

Please read these Terms carefully before using the Service. By beginning to use the Service (including downloading, installing, opening, browsing, or subscribing), you agree to and accept all terms of this agreement. These Terms, together with the BabbleNest Privacy Policy, form the basis of your use of the Service.

1. Service Description

BabbleNest is a language learning application designed specifically for children. We provide a safe, friendly early language learning environment for kids through interactive flashcards, audio playback, and progress tracking. The Service includes free content and additional content that requires a paid subscription to unlock.

2. Paid Subscriptions

1. Subscription model:

You can use some features of the Service for free. To unlock all categories and premium features (such as random mode), you need to purchase our paid subscription. We offer multiple subscription periods (monthly, annual, and lifetime), with prices as displayed in the App's purchase page.

2. Free trial:

We may offer a one-time 7-day free trial for specific subscription plans (e.g., first-time monthly subscribers). During the trial period, you can access all paid features. After the trial period ends, your subscription will automatically convert to a paid monthly subscription and will be charged by the Apple App Store, unless you cancel at least 24 hours before the trial period ends.

You can manage your trial in your Apple ID account's "Subscriptions" settings.

3. Auto-renewal:

To provide you with uninterrupted service, monthly and annual subscription plans are set to "auto-renewal" mode. This means that at the end of each subscription period, your subscription will automatically renew at the same price and period, unless you cancel at least 24 hours before the current subscription period ends. Please note that the "Lifetime" plan is a one-time purchase and is not subject to auto-renewal.

4. Payment and billing:

All payment processes are handled and managed by Apple's App Store payment system. Your payment information is stored by Apple, and we do not collect or store any of your payment account information (such as credit card numbers).

5. How to cancel your subscription:

You must manage and cancel your subscription through your Apple ID account settings. Simply deleting the App does not cancel your subscription or auto-renewal.

  • Steps: Open the "Settings" app on your device → Tap your Apple ID profile → Select "Subscriptions" → Find "BabbleNest" and manage it.

6. Restore purchases:

If you switch devices or reinstall the App, you can use our "Restore Purchase" feature. This feature will verify your previous valid purchase records (including subscriptions and lifetime purchases) through the App Store and restore the corresponding service permissions on your new device, so you don't need to pay again.

7. Changes to prices and terms:

We reserve the right to adjust subscription prices and terms. Any price changes will take effect at the next subscription cycle after notifying you.

3. Intellectual Property

All content included in the Service, including but not limited to text, images, audio, trademarks (such as "BabbleNest" and related icons), software, and code, is owned by us. We grant you a personal, non-transferable, non-exclusive license to use the Service for personal and non-commercial purposes only. You may not copy, modify, distribute, sell, or rent any part of the Service.

4. User Conduct

You agree not to use the Service for any illegal or improper purposes, including but not limited to:

  • Reverse engineering, decompiling, or cracking the App.
  • Using any means to interfere with or disrupt the normal operation of the Service.
  • Sharing, lending, or transferring your subscription account to others.
  • Using the Service for any commercial purposes.

5. Disclaimers and Limitation of Liability

1. The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be completely uninterrupted or error-free.

2. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or punitive damages arising from your use of or inability to use the Service. Our total liability to you shall not exceed the total amount you have paid us for the Service in the past twelve months (if any).

6. Termination

You may stop using the Service at any time. If we believe that you have seriously violated any provision of these Terms, we reserve the right to suspend or terminate your access to the Service without prior notice.

7. Changes to These Terms

We may revise these Terms from time to time. When significant changes occur, we will notify you through app version updates and by providing the new version of the Terms in the settings page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
